According to the Washington Post, five justices on the Supreme Court are going to rule in favor of striking down Roe v. Wade despite threats, doxxing, and outrage from leftists and pro-abortion groups following last week’s draft majority opinion, written by Justice Samuel Alito, was leaked to Politico.
Justices Alito, Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, Amy Coney Barrett, as revealed in the initial leaked draft majority opinion, were set to vote in favor of overturning Roe v. Wade, Valiant News previously reported.
The three liberal SCOTUS justices — Justices Stephen Breyer, Sonia Sotomayor, and Elena Kagan — are presumed to have voted against overturning it.
It remains unclear if Chief Justice John Roberts will join with the conservatives and vote to strike down the controversial abortion ruling, though he was rumored to be offering a mixed opinion that would agree with conservatives on some parts but stop short of agreeing that Roe v. Wade should be overturned.
However, according to the Post, the number of justices ruling in favor of overturning Roe sits at five despite ongoing leftist intimidation campaigns.
“Three conservatives close to the court” told the Post that “the majority of five justices to strike Roe remains intact,” adding that “the leaked draft opinion is dated in February and is almost surely obsolete now, as justices have had time to offer dissents and revisions.”
“But as of last week, the majority of five justices to strike Roe remains intact, according to three conservatives close to the court who, like others, spoke on the condition of anonymity to discuss a sensitive matter,” the Post reported.
Should Roberts rule with the conservative wing of the court to overturn Roe, the official decision would be 6-3 in favor of striking the precedent down, thus giving states the final say on the issue of abortion in America.
It would still constitute a majority, as it currently stands, if Roberts voted against overturning Roe, as the official decision would still be 5-4.
Roberts recently told judges who gathered for the 11th Circuit Judicial Conference meeting in Atlanta, Georgia that there was no way the recent leak of a draft decision that would overturn Roe v. Wade would change the Court’s plans.
Roberts appeared to question how the information got out, potentially suggesting it may have been stolen and not leaked, and characterized it as “absolutely appalling.”
Still, Roberts said it would be “foolish” to think such a leak would prevent the Supreme Court from doing its job, Valiant News reported.
