Conservatives claim Harvard University is promising to use a “loophole” in the Supreme Court ruling that bans affirmative action practices in colleges and universities.
Today the Supreme Court determined that racial preferences and quotes, or affirmative action, violates the Equal Protection Clause of the United States Constitution in a 6-3 ruling that struck down the admissions policies of the University of North Carolina and Harvard, according to Breitbart News.
Now, Harvard appears to believe it can use essays from prospective students to determine racial attributes of individuals and admit them accordingly. According to an email sent by Harvard to reporters, including Eliana Johnson at The Free Beacon:
Today, the Supreme Court delivered its decision in Students for Fair Admissions v. President and Fellows of Harvard College. The Court held that Harvard College’s admissions system does not comply with the principles of the equal protection clause embodied in Title VI of the Civil Rights Act. The Court also ruled that colleges and universities may consider in admissions decisions “an applicant’s discussion of how race affected his or her life, be it through discrimination, inspiration, or otherwise.” We will certainly comply with the Court’s decision.
Timcast host Tim Pool wrote the email means a “New loophole for racists,” radio host Jesse Kelly warned that “the entire United States of America is now based on this explicitly communist way of thinking” and the thus the decision “won’t change anything.” Another user blamed Chief Justice John Roberts for writing “an exception directly into the opinion” to make this possible.

Still, most Republicans have hailed the decision as a landmark victory for conservatives, particularly those concerned with anti-white and anti-Asian racism in higher education.
“People with extraordinary ability and everything else necessary for success, including future greatness for our country, are finally being rewarded,” wrote 45th President Donald Trump in a statement. “This is the ruling everyone was waiting and hoping for and the result was amazing. It will also keep us competitive with the rest of the world. Our greatest minds must be cherished and that’s what this wonderful day has brought. We’re going back to all merit-based — and that’s the way it should be!”
Anti-woke hedge fund manager and pro-Trump Republican presidential candidate Vivek Ramaswamy echoed the remarks in a video posted to social media.
“Affirmative action is the single greatest form of institutional racism in America today,” wrote Ramaswamy on Twitter before promising “As President, I will end it in every sphere of American life.”

Florida Gov. Ron DeSantis wrote on Twitter that “College admissions should be based on merit and applicants should not be judged on their race or ethnicity” and said the Supreme Court “correctly upheld the Constitution” in the landmark ruling.
